The kylminaator.ee website is owned by Külminaator OÜ (registration number 10049504), at Kalmistu tee 28A, Tallinn 11216, Estonia.
Validity of the sales contract, product and price information
These sales terms apply to purchases from Külminaator OÜ, including orders agreed following an enquiry submitted through the website.
Prices for products sold in the Online Store are displayed beside the products. Product prices published on kylminaator.ee include 24% VAT. Handling and delivery charges are added to the price.
Delivery charges depend on the volume of the goods, the buyer's location and the delivery method. The method and charge are agreed with the buyer in the quotation or order confirmation.
Product information is provided beside each product in the Online Store.
The disposal fee is included in product prices
Producer responsibility has applied to electrical and electronic equipment since 13 August 2005. This means producers must collect equipment placed on the market at the end of its useful life and ensure it is properly treated. For the purposes of the legislation governing this sector, all importers of electrical and electronic equipment are producers. In addition to equipment placed on the market after 13 August 2005, the legislation makes producers responsible for products placed on the market before that date, known as historical waste. Active importers share responsibility for historical waste, with costs allocated according to their market share in sales of the relevant type of equipment.
Külminaator OÜ is a member of the producer responsibility organisation MTÜ Eesti Elektroonikaromu, which arranges electronic waste collection and recovery in accordance with applicable requirements, working with licensed waste handlers. Külminaator OÜ delegates its electronic waste collection, recovery and disposal obligations to Eesti Elektroonikaromu. Product prices therefore include an electronic waste treatment and recovery fee, also called a disposal fee, paid by equipment importers to the producer responsibility organisation for disposal of the equipment.
The disposal fee for electrical and electronic equipment allows consumers to return unusable or old electronic equipment to the producer responsibility organisation.

Sending an enquiry, confirming an order and payment
You can send a product enquiry through kylminaator.ee. The website does not accept online purchase payments.
1) Sending an enquiry through the website
Add the products you need to the basket and send an enquiry with your contact details. Products without a listed price can also be added. Sending an enquiry is not a purchase or an order carrying an obligation to pay. We will separately agree availability, price, delivery method, delivery time and payment terms with you and confirm the order.
Sending an enquiry alone does not conclude a sales contract. For a separately confirmed order, the contract takes effect when the amount due reaches Külminaator OÜ's bank account.
If the ordered goods cannot be delivered because they are out of stock or for another reason, the Buyer will be informed as soon as possible. Payments, including delivery costs, will be refunded without delay and no later than 14 days after receipt of the withdrawal notice.
2) You can choose products on kylminaator.ee and complete your purchase at Külminaator OÜ's showroom at Kalmistu tee 28A, Tallinn. Payment can be made there in cash or through online banking.
Delivery and transport
Products are delivered to the customer's chosen address using the delivery method agreed when the order is confirmed.
The delivery options are:
- Collection in person (Kalmistu tee 28A, Tallinn)
- Delivery by agreement: we will contact you.
Külminaator OÜ and its logistics partner are responsible for the ordered goods during transport from the Külminaator OÜ warehouse until delivery to the customer. Külminaator OÜ guarantees replacement of the product or reimbursement of its value if the shipment is lost or damaged between dispatch and handover at the customer's specified address. Transport charges depend on product dimensions, quantity and delivery address.
The buyer pays the shipping costs. The delivery method and charge are agreed in the quotation or order confirmation.
Collection in person: collect the goods from Külminaator OÜ warehouse no. 1 at Kalmistu tee 28A, Tallinn, Estonia.
Goods can be collected free of charge from Külminaator warehouse no. 1 at Kalmistu tee 28A, Tallinn, during opening hours, Monday to Friday, 9:00–17:00.
Goods are released on presentation of an identity document (ID card, passport or driving licence) and the order number. The Online Store may refuse to release the goods if no identity document is presented.
The Online Store is not liable for loss suffered by the customer if, for reasons not attributable to the Online Store, a third party obtains a copy of the invoice or the unique order number and uses it to collect the goods.
If the customer does not collect the goods within 14 calendar days, the Online Store will notify the customer after that period that a daily storage fee will apply according to the Külminaator OÜ price list. After receiving the notification, the customer must inform the Online Store when collection is planned. Storage fees accrue until handover. Goods are released after payment of the storage fees incurred.
Delivery by agreement: we will contact you
For delivery by agreement, including courier delivery or transport provided by Külminaator OÜ, the Online Store contacts the customer in advance to agree the delivery method, time, cost and payment terms. Goods are delivered to the customer's specified address within 3–7 working days after purchase unless otherwise agreed. The exact handover time is agreed in advance by telephone or SMS.
The customer must ensure that the goods can be received at the agreed time and address. If the customer is unavailable when the goods arrive, the Online Store treats the journey as an unsuccessful delivery. The delivery fee is non-refundable.
The Online Store returns the goods to its warehouse, and storage fees apply from the following day. If the customer requests another delivery by the Online Store, a further transport charge must be paid.
Checking the goods
On receipt of the goods, the customer must open the packaging carefully without damaging the packaging or products. If the customer negligently damages packaging that could have been opened without damage, the Online Store may claim compensation when the goods are returned. If packaging cannot be opened without damage or destruction, the customer is not liable for the damaged packaging.
If the customer discovers on receipt that the wrong or defective goods have been sent, or that the goods have not arrived in good condition and sealed packaging, the customer must immediately inform Online Store customer service at epood@kylminaator.ee or +372 6729530. If the goods or packaging are damaged, include a photograph documenting the damage.
The Online Store is responsible for the purchased goods during transport. The risk of damage or loss passes to the customer when the goods are received.

Right of withdrawal
After receiving the goods, a consumer buyer may withdraw from a distance sales contract within 14 days under the conditions below. Sending an enquiry alone does not conclude a sales contract.
Under section 53(4) of the Law of Obligations Act, there is no right of withdrawal for goods made to the consumer's specifications.
The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of return, goods must not be used beyond what is necessary to establish their nature, characteristics and functioning, in the same way as testing goods in a physical shop.
If goods have been used beyond what is necessary to establish their nature, characteristics and functioning, or show signs of use or wear, the Online Store may reduce the refund to reflect the reduction in value.
The product must be returned in its original packaging.
To return goods, submit a withdrawal statement using the form available here: withdrawal form and send it to epood@kylminaator.ee no later than 14 days after receiving the goods.
The Buyer pays return costs, except where goods are returned because they do not match the order, for example incorrect or defective goods.
The Buyer must return the goods within 14 days of submitting the statement or provide evidence that the goods were handed to a carrier within that period.
On receipt of the returned goods, the Online Store refunds all payments received under the contract without delay and no later than 14 days after receiving the withdrawal statement.
The Online Store may withhold reimbursement until it has received the goods or the Buyer has provided evidence of returning them, whichever occurs first.
If the Buyer expressly selected a delivery method other than the least expensive standard option offered by the Online Store, the Online Store does not have to reimburse costs exceeding the standard delivery charge.
The Online Store may withdraw from the sale if, due to an error, the displayed price is substantially below the actual or market price of the goods.
Right to make a complaint
The Online Store is liable for goods sold to the Buyer that do not conform to the contract or have a defect that existed at handover and becomes apparent within two years of delivery to the Buyer.
If a defect becomes apparent, the Buyer may contact the Online Store within two months at epood@kylminaator.ee or +372 6729530.
The Online Store is not liable for defects that arise after the goods are handed over to the Buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, it will repair or replace them. If repair or replacement is not possible, the Online Store refunds all payments under the sales contract within 15 days.
The Online Store responds to consumer complaints in writing or a form reproducible in writing within 15 days.
Dispute resolution
Complaints concerning the Online Store should be sent to epood@kylminaator.ee or reported by telephone on +372 6729530.
If the Buyer and the Online Store cannot resolve a dispute by agreement, the Buyer may contact the Consumer Disputes Committee. The procedural terms and application form are available here. The Committee may resolve disputes arising from a contract between the Buyer and the Online Store. Consideration of the Buyer's complaint by the Committee is free of charge.
